Demand Letter due to Debt: Postpaid Plans

Have you received a demand letter from a certain Telecommunication company because of unpaid bills from your Plan? 


  • Major telco's in the Philippines are Globe, Smart, and DITO. TM is under Globe and TNT is under Smart.
  • Major Postpaid providers are SMART and GLOBE


You had an Iphone through postpaid plan from *lobe or S*art but failed to settle the balance. Have you received a letter like below? 


Our client, *lob* Telecom, has referred to us for immediate legal action the matter of your unjustified refusal to pay the amount of P 00000.00 as of February 29, 2029 consisting of unpaid balance for the cancelled/terminated globe postpaid account number XXXXXXX.

          

Our client’s records show that since the month of  1/1/2028 and until now, despite repeated demands from our clients, you have failed to pay the total amount of P 00000. Your continued refusal to pay our client despite repeated demands only shows malice and callousness on your part certainly designed to cause damage to our client.

 

In view thereof, DEMAND is hereby made upon you to pay our client the total amount of P 00000 within five (5) days from receipt hereof otherwise we shall be constrained, much to our regret, to institute the necessary court actions against you and all your responsible officers in order to protect and preserve the interest of our client under the law.

This is a typical demand letter from a Collections Agency. Actually, this is not anymore from your Telecommunications company that you have debt but rather, from the current collections agency who is handling it.

Of course, my first advise would be Pay the balance as it your due. You purchased a smartphone / Iphone, then you have to pay. It is your responsibility.

BUT WHAT IF YOU CAN'T PAY?

So, nandiyan na ang Collections Agency, nagsend na ng demand letter. What to do? 

First, is kalma muna. Always remember, "WALANG NAKUKULONG SA PAGKA-UTANG".

No person shall be imprisoned because of debt. 

"Pero, nabanggit sa letter na has referred to us for immediate legal action the matter, ibig sabihin di ba kakasuhan ako?

Possible, but it rarely happens. Ang term na legal action is one way of intimidating you. Demand letter palang ito. Hindi ito ang legal action and usually, hindi talaga yan nagdedemanda yung mga companies na eto. Bakit? Magasto. Too expensive to hire lawyers and schedule hearings to get a verdict na "pay when able". 

Actually, once nareceive mo na ang Demand letter, ang Collections Agency na actually ang naghahabol sayo. Sila ang mangungulit at manghaharass sayo.

You can identify na collections agency sila dahil sa hindi customer service hotline nang pinagkaka-utangan mo ang line and second, sa email address din niya. You will also see in the signature that it is a different company.

You are not obligated to answer to this Collection Agent. And they play dirty. This is only my opinion but better ignore them.

  1. Hi po, Same situation po ako nito. I have received the exact same letter from Globe. Question ko lang po, does credit collection agency file cases for unfinished subscription contracts? Ano po kaya worst scenario for this kind of case if hindi pa tapos payment for the phone unit na bundled with the postpaid plan? Not intentional naman po na madefault kaso na-covid yung nagamit ng plan. Hindi din po namin sinasagot ang credit collector's calls kasi gusto one-time payment of 50,000 yung previous balance of less than 15,000 lang. May termination fees daw kasi kaya bloated na yung amount. Thank you sa sasagot.

      As suggested by one of the commenters, if wala kang pambayad, then tell the collectors na wala kang pambayad. Be prepared sa tactics ng mga Collections Agency, they will email you, call you, and some poses as police man. But remember, they are just trying to scare you. Court order? Wala po sila niyan. Yung text at emails nila ay demand letters lang.

    1. hmm hindi rin, (in my case sa internet connectivity) what if tinawagan mo na sila ng paulit ulit para iterminate acount since lilipat na ng bahay at tapos naman na contract, sinasabing iapply sa email, sa messenger, sa app then bigla mawawala during the call at inonote daw (several times) di mo na nga nagagamit sinisingil ka pa. natawagan mo na nga pero sasabihing walang record na tumawag para iterminate.

Kahit anong gawin mong tawag. hindi nila gagawin yan. yung sa akin, paterminate ako. wala din. sige singil. chat ako messenger. mabuti nalang screenshot ko messages ko. Pumunta ako sa Globe center mismo. Sabi ng customer service wala daw silang request natanggap at wala daw note. P*chang in*, pinakita ko messages at conversation namin sa messenger ng agent nila. Yun hinonor nila at nagcredit back pa. Kakaiinis talaga tong mga service provider na it.

    1. Hi po, email lang po ito usually pinapadala. Pero kung nakakareceive ka dati ng physical mail sa bills mo sa globe or smart, then possible din magpadala sila ng demand letter through mail.

  4. I've been emailed, texted, and called by the said "Third party agency' that Smart hired my unpaid Smart Signature Plan. Will I be put behind bars? Im scared out of my mind and I cant pay since I lost my job. Help 😭

    1. "Third party agency" are collections agency. Their goal is to collect your debt for SMART. In short, they want to collect money. They will employ many tactics for you to pay even if you are struggling. They will say makukulong ka. Or may kaso against you. Wag maniwala kaagad. Dapat mayroong court order niyan and hindi ang collections agency ang magbibigay sayo ng document na may kaso ka. If sabihin nila may warrant sila or my court order sila, hingan mo ng document. sigurado ako walang maipapakita yan. If sabihin nila na mayroon sila, hingin mo at sabihin na ipapacheck mo ang legality. Wala yan ma-iproproduce. Wag kang matakot ang be rational sa pagharap mo sa problemang eto. Yung relationship niyo ni smart is debtor-creditor / nangungutang at nagpapa-utang. This is my two-cents (opinion), if may kaibigan kang abogado, pwede ka ring magtanong if kinakabahan ka pa rin.

    1. Yan talaga ang safety net ng mga post paid plans and CC. Kung ma default ka, lalaki kaagad ang bayarin mo. Kung may pangbayad ka na sa initial na utang mo na 50k, then haggle ka. Negotiate. I don't advice paying the 100k. It is too much. Sa totoo lang, mga 30k, maligaya na ang mga collector niyan.

Experience ko, opo, bumisita sa office. hinahanap ako. di naman sila makapasok kasi hinarang ng guard. buti night shift ako. sabi ng guard familiar sila sa mga taong ito. ilang beses na din sila naka encounter ng ganito. mga naghahanap ng may utang.... sa labas lang talaga sila, di pinapapasok.

    4. Ito experience ko. Pumunta sila sa barangay, nagpasama sa apartment ko. . takot na takot ako. may kaso daw ako at gustong pumasok sa unit ko. grabe, helpless talaga ako sa moment na iyon.   8. nakatanggap po ako ng demand letter sa bahay from bustos law office saying i have a debt from smart. the name and address is exactly mine but the account number or sim number is not mine and incorect when i try to call it. what this supposed to mean? anf i dont even have a transactions with smart.

    1. Hi, dalawa ang nakikita kong possible reasons dito. First this is a SCAM. Second, if sigurado kang hindi sayo, then someone might have applied under your name. Of course, the possibility na SCAM ito ay malaki. You can actually verify with SMART if totoo ba ang account number. They have messenger or chat support. Itry mong i-verify kung totoo ba ang account number and if sayo ba talaga nakapangalan. If wala, eh di scam yan.

    2. Hi po, depende po yan kung anong banko. Most of the law firms na nagtetext or nag-eemail sa inyo ay mga Collections Agency. They are hired by the bank to collect the due debt from defaulters. Hindi po sila hinire para magfile ng kaso kundi para kulitin kayo para bayaran yung utang. At isa po sa pinaka-pinakafavorite nilang tactics to make you pay is saying they will file a case against you. Yung mga banko kasi, they have their own legal team who handle filing cases. Tingnan po ninyo yung list na nasa ibaba, if nandiyan yung law firm, then collections agency po yan.

  11. Hello. Same situation po. Ive been receiving calls po regarding sa account ko na hindi pa nabayaran. 87k po ang sinisingil sakin. Then one time natawagan nila ako and they saud they are from SSG company. They will visit me daw po sa bahay. Kaya po nagsabi ako na I can pay through staggered amount. Pero sinisingil nila ako ng 26k as downpayment them Babayaran ko yung yung remaining for 8 months. Medyo hindi pa po kasi kaya. Ano po kaya pwede gawin?

    1. You have several options. Una, you can ignore the calls if wala ka talagang pambayad. Wag po sa staggered, your debt will only balloon. Mahirap kasi imaintain ang staggered payment unless committed ka na mababayaran. Second is haggle for a more ideal payment method. Be patient. Sasabihin nila na hindi pwede at eto lang yung offer but they will again contact you for a much better deal. Also, pakicheck sa baba kung nandiyan ba ang collections agency sa lista.

Hello po, kumuha po ako ng Smart Communication Plan ng Sim lang kasi sabi ng seller 499 lang daw babayaran ko sir at dun na enganyo po ako bumili pero after 4 months hindi na 499 yung bill, naging 1,500 na sometimes 1000 kayat, nag start na talaga akong hindi binabayaran yung SMART PLAN kong sim sir , tpus may nag email sa akin from BUSTOS LAW FIRM Na pag binibigyan ako ng 7 days para bayaran ang 14,000.00 , huhuhu ano gagawin ko sir.? So yes, they are a legal collections agency na naghahabol sa mga may utang na tulad sa iyo. But they only collect. The term they use na kakasuhan ka is one of their tactics to make you pay. They won't pursue a case. Masyadong magastos for them. And if they do, it will only be a civil case for a collection of sum of money. It is "Pay When Able". Yung mangyayari lang talaga sa yo is that you are blacklisted with SMART/PLDT. But they wont really pursue a case. Kung may pambayad ka, then pay, if wala, then I suggest ignore it.

  14. Hi i have same situation they asked me to.pay 33k one time payment, i dont have anything so I ignored and keep receiving email then law firn was the one chasing me law firm was M.L. SOBREDILLA LAW OFFICE , asking to pay with in 5 days then ignored then they email again with threatening they will file small court claims, im so scared. kasi ang utang ko lang is 11k but there is extra fees and temnation of more than 29k. is this true?? they will file small court claims.

    1. Hi po, as you can check on the link below, the law firm is an accredited collections agency. This means they are partnered by the bank to collect the said amount.

      There are banks that files small court claims like BPI and HSBC. But it is a collection of sum of money. It is a CIVIL case and not a criminal case. Others actually prefer it because it actually lower the amount what the bank is claiming and it is pay when able (fi you don't have a bank account in the same entity).

      But most likely, hindi yan. The collections agency for most part is only tasked to collect the money and court filing are one way they use to threaten defaulters to pay.

  15. I received the same email. The frustrating part is hindi ako nagkulang sa pagtawag for follow ups tapos mababasa ko sa email na nag eemail sila and demand? ANG LABO. 11k plus is not a joke. Breadwinner ako ng family. Never akong nagkaproblema sa bills and the agent before assured me na all is well, then there’s that email. If I will not pay the amount, what will happen po? Mahihirapan po ba ako mag apply sa future ng loans or will it affect my credit score sa mga banks? or will it also affect if I am applying for visa? Mag aabroad po sana ako then mababasa ko tong email na may legal court pa silang nalalaman, mas lalo akong nafufrustrate. Please answer po sa mag similar case.

    1. For future loans, what I know is banks share a Blacklist file which details defaulters from their respective banks. But still the bank loan approval depends on sa issuing bank. Kasi even if blacklist ka sa isang banko but di naman ganon kalaki ang utang mo and you have a good record, they still consider.


      Now sa VISA mo, I am not expert but what I can say is it is a CIVIL case only kung sakali man na magfile ng case which is rare sa banks unless BPI or HSBC. Hindi naman criminal case ang kaso mo.

And same sa others na they will give me 7 days to settle the account upon receiving the letter. So my question is, nakapagpakulong na ba ang bustos law firm or they will just continue to send me mails and call me from time to time. I'm nervous AF... Di naman sya intentional na madefault. I have reasons, i needed money since my mom lost her job and need din namin magbayad for my sibling's tuition fee. Education is priority so napilitan na ako na madefault.     1. Hi, sorry for the late response. Una, walang nakukulong sa pagkaka utang. If the question is will bustos law firm file a case, it is unlikely. Sa description mo, the law firm is a credit collector. What they do is contact you everyday so they can collect money from you. If you dont have money to pay, then best ignore them. They will employ though other tactics, so itnis better to have a prepared mindset when dealing with collectors.

  17. Same! Yung collections ng smart nangungulit din about sa debt ko na 34k plus nawala na kase ung unit at sim ko kaya di nako nakabayad hindi ko alam yung account number ko. Tapos ngayon nag eemail sila na need na daw i settle uung debt eh kaso wala pako pera :( i know naman na walang nakukulong sa utang pero yung peace of mind ang hirap

    1. Yes, yan po ang mahirap sa may utang na na endorse sa collections agency. Ang peace of mind. You will have trust issues answering phone calls and emails. They will also contact your work. Tibayan nalang po ang loob and know how to protect oneself mentally.

  18. Hello po sorry to ask pero what will happen duon sa iphone na kasama ng plan na knuha ko. Walang pnacash out so prang libre tlga ung iphone sa plan na knuha ko. Kaso di ko na mabayaran dahil nawalan ako work nagsara ung account. Mabblock ba ung phone? Di ko na siya magagamit kahit da ibang sim na globe?

    1. Hi jen, I am not familiar with postpaid policies. Basta natatandaan ko magagamit mo pa din yung phone even if you don't pay the plan. yung sim mo lang yung mablo2ck or unusable. you can still insert a different sim. of course it might have change specially with the prices of the iphone right now. The providers might have establish some actions to protect themselves from defaulters. hopefully, someone who has more knowledge can answer your question.

    1. Hi po, wala pa akong naririning na nagfi2le ng kaso ang PNB against defaulters maliban nalang kung may fraud. Usually, inirerefer nila sa collectons agency ang pagkuha ng utang.

    1. Even if you ignore it, they will also send it through other means. The issuance of the demand letter is the lender's right. It will be your prerogative to receive it or to ignore. Actually, demand letters just needs to be sent to the last known address of the debtor. Ang assumption na po niyan is nareceive mo yung demand letter.

  21. I've been reading through this since meron din akong na default na plan sa Smart. I've been ignoring the calls as suggested above. Today, I received an sms na they conducted a visit daw sa lumang address where i used to rent. Then magpapadala daw sila ng demand letter sa office. Eh wala pa ako pambayad. Not sure what to do. I have no way of confirming if nag visit talaga sila. Summit Office daw name nung company.

    1. Hi po, that is the normal tactics of the CA's. They do send demand letters sa office and call the office of the defaulters. It's something that they do kung hindi nila macontact ang nangutang or if hindi nagbabayad. Kasi if you tell them wala kang pambayad, the will kept calling you everyday. Hanggang mapagod ka. You will not answer anymore, then they will call your office. Same cycle.

    1. Depende po yan sa kontrata na Bank and CA. Usually from experience, they wil lcall or contact you for 3 months. 6 months if bago palang. Then if di mo sinasagot, they will stop. Then if another CA takes over they will call you again. They will stop then again. it is cyclic.

  23. hindi po ba sila titigil mangulit? kasi po yung experience ko e, binigay lang po yung smart sim at nung inactivate ko po ay may utang nang 1k. ngayon ang hinahabol na sa.min ay 12k kahit wala kaming nagamit na service. 2 months ago nagsend sila demand letter, nagpalit kami sim at until now hindi na ag contact. should i be releived or may worse pang paparating?

    1. For postpaid, they usually stop. Specially if hindi ka na macontact. Especially if SIM lang. That calculation na aabot sa 12k is over at hindi talaga yan yung actual na babayaran niyo dapat. Pinalaki ng kanilang "penalties". The worst case scenario lang is hindi ka na kakakuha ng service nila.

    1. The postpaid plan includes one phone and one tablet. Di ko po sya nabayaran due to financial problems. Magrereflect po ba xa sa NBI records ko?

    2. Debts if a case is filed by Service Provider is a civil case. NBI does not handle civil cases. So hindi po. usually, sa mga credit database lang magrereflect pangalan mo.

    1. Ano po yung full message? If its a random number at hindi nagpakilala sayo kung sino sila (like name at anong posisyon), possible hindi taga NBI yan. NBI will also not contact you for breach of contract. These are collectors trying to make you pay the 5500. at most, ang kaso sayo is collection of sum of money.

Had a payable with globe. postpaid, 7000. hindi ko binayaran kasi ayaw akong asikasuhin ng customer service for dispute. pinadidisconnect ko ayaw pa din. contact ng contact yung agency, nbi daw sila, court, police. etc. pinabayaan ko., hanggang ngayon wala namang nangyayari. yun lang di na ako makatransact sa globe for anything. so ako sayo, wag intindihin yan. mga collector lang yan.

  26. Hello po I have a question po, meron po kasi akong hindi nabayaran na smary postpaid with device na plan and naka received na po ako ng law firm email. Kinakabahan po ako kasi wala na po ako pambayad and mas kinakabahan po ako na mag home visit sila, since ang address ko po na naka lagay doon is yung dati ko pong tinutuluyan na kamag anak. Pwede ko po bang ipa change sa current address ko yung records nila para di na po dagdag problema? Kinakabahan po ako lalo na at alam ko din po na kasalanan ko po din po lahat ng ito.

    2. Hi po, I know how stressfull this is, I hope okay kalang. kung sinasagot niyo po yung tawag nila, i suggest ipa-update niyo ang address mo sa kanila or sa mismo sa postpaid provider m9o. Kung nasa collections na kasi, malaki ang chances na vivisit sila. Yung visit kasi panakot nila yan, so depende sa kanina if bibisitahin nila ang lugar mo o hindi. But to proivde you peace of mind, ipa-update mo nalang ang address mo. Mas maganda kung mismo sa postpaid provider mo kasi once mag-end ang contract, iba nnman na Collections Agents ang kukunin nila sa sunod and if ang record sa provider mo ay yung dating address, then yun yung susundin nila.

  27. Hi! I got emailed from summit office saying na may utang daw ako na 63k for my smart plan. Nagkaroon ako ng past dues for 7 months. But i already settled it. And nakaka received din ako ng email sa smart na 0 bill na ako. But this Summit Office kept on pestering me na i need ko pa bayaran yung natitirang 54k. Then tumatawag ngayon sa dati kong tinitirhan saying na they will visit me sa office. Is there something i can do? Pupunta po ba talaga sa opisina?

    1. Hi po, humingi ka nang certification sa SMART po na bayad ka na at wala ka ng utang sa kanina. This is your best evidence and pwede mong gamitin against sa kanina. If wala ka ng utang, then email po sila sabihin na eto po attachment from SMART na fully paid na ako at settled na ang balance ko. Then i-copy niyo po ang BSP - consumeraffairs@bsp.gov.ph. Then let them know that you will report them for harassment as you have already paid the full amount. They have already violated DATA PRIVACY ACT by contacting other persons.

  28. Hi! Is there a law about imposing unfair interest?
    I have smart plan w/ device which will end the 24month contract this November. But nagkaroon ako ng pastdues for 7 months and nagsabi ako sa customer service na i will pay the full amount before my contract ends this November dahil nagkaroon lang ako ng financial problem. But october palang binayaran ko na in full ang outstanding balance. Recently naka received ako ng email from collection agency na i still have balance of 50k+ upon confirming sa smart those are the interest which is katumbas na din ng 2yr contract ko. Now i decided na hindi ko nalang bayaran dahil unfair na binigay na nila ang info ko sa collection agency when in fact nasa lock-in period pako ngayon and hindi ko narin naman nagagamit ang service nila since June. I ignore their emails but araw araw sila tumatawag sa landline and sinasabi na i-site visit ako. Is it true? If in case, ano po ang pwede ko ilaban sa unfair interest nila? Thank you.

    1. Hi po, I know how stressing this is. I just wanted to point a few things. Alam ko hindi ito ang gusto mong mabasa.The thing is my kakayanan gawin ang mga service provider based sa contract na pinirmahan niyo. Specially plans with the devices kasi yung device ay parang "inutang" mo sa kanina.Even if wala ka ng service, yung device kasi nandiyan pa sayo. So like a credit card, yung stipulated interest sa contrata niyo will run. Yung mahirap pa diya is once hindi ka makabayad for succedding months, may penalty clauses sila na ang taas ng interes. That's what happen in your case. And yes, napaka laki talaga niyan at hindi makatao dahil doble pa sa original na utang mo.

      They can endorse demandable debts to collection agents kaya nandun sa agents yung utang mo.

      You can negotiate but its really hard to negotiate with Collection Agents. Yung amount talaga yung i-co2llect nila. Yan talaga ang technic nila, araw2 na makulit at manghaharass. They do some called "site visit" which is pupunta collector nila, magpapakilala na "pulis" daw etc. Lalo na if nasa metro manila ka kasi accessible sa kanila. But technically, wala silang magagawa naman. Basta wag kang magpapapasok sa bahay. Wag kang mag-invite. Sa labas lang talaga. Wag ka din maniwala kaagad sa pinagsasabi nila. na may kaso ka daw. kung nasa collection agents pa ang bola, wala pang kaso yan. kunin mo mga pangalan nila to be safe kasi they will harass you everyday.

      For unfair interest, it is the judge that can decide. So kung may kaso which is CIVIL case, diyan na po magdedecide ang judge na masyadong malaki ang interest and they will set a certain amount. If you want, you can also intitate a case pero mahirap kasi magastos ang abogado.

      Kung makakahintay ka, baka within three months matapos na kontrata ng SMART with CA, then negotiate directly with SMART. Maybe they can lower your interest pa.

    2. Advise ko lang sa readers po . . . if demandable na ang amount mo or flagged na for collection. Make sure to coordinate lang muna sa institution bago magbayad . . . kasi what happens is yung bayad mo parang binayad mo lang sa interest. . . Wag muna magbayad unless mayroong kang SOA at natapos na lahat disputes. . .

    3. Is it okay if i just ignore the calls, email and demand letter from them? If mag site visit sila wala narin naman ako sa dati kong tirahan and sa office hindi naman sila basta makakapasok. Also pasok ba itong case ko for small claims if ever na pag aksayahan nila ako ng panahon at dalhin sa korte? Thanks

    4. This is based on experience but you can ignore it. I have an debt sa bank for almost 100k due interest. Wala akong pambayad. So ignore ko lahat ng calls. Tried to call my company, wala eh night shift ako. Then tried to go to my address, hindi sila papasok ng mga guard. Nagpakilala na pulis, etc. That's how i learned na ganito pala kalakalan ng mga CAs. Yes po, technically pasok sa small claims but wala pa akong naririnig na nagkaso talaga ang mga service provider.

      If magkaso, sabi panga nila, basta may ruling na ang judge. Pay when able.

  29. I also have issues with Gl*be plan with gadget. Yung phone ninakaw and yung sim. They are emailing me. Kaya ko naman bayaran pero 15k lang kaya ko. 😭

    1. Kung Collections agent na po yan. mahirap po talaga. They will email you and call you. mahirap din po sila magcompromise.

  30. hello, i have the same problem din po, same email, from collection agency ata, nagwoworry lang ako baka mag home visit sila. is it possible po ba?

    1. Hi po, good evening. hope you are okay. I know malaki ang stress na binibigay ng mga CA. If you are in metro manila or in major cities, malaki ang chance na gumagawa sila ng visits. If gumawas sila ng bisita, you have the option na sa labas lang sila. They can't actually enter your house without your consent. Kung pumunta sila, sa labas lang talaga sila. It is trespassing.
